COVID-19 emergency financial hardship payments
Queensland Parliament has passed legislation for building and construction and contract cleaning industry workers who are experiencing financial hardship due to the COVID-19 emergency. The temporary amendments to the Building and Construction Industry (Portable Long Service Leave) Act 1991 and Contract Cleaning Industry (Portable Long Service Leave) Act 2005 allow registered workers, with at least five years of service, to apply for payment of all, or part, of their long service entitlement. These payments will only be available until 31 December 2020 and workers will need to meet the criteria to access a financial hardship claim. Workers who are eligible to make a financial hardship claim should complete the COVID-19 Financial hardship claim form. It's important to note that accessing portable long service leave on financial hardship grounds will reduce a worker’s long service leave balance by the amount they elect to access if approved. Workers under these schemes will continue to accrue service credits for any eligible work they perform.
QLeave encourages workers to seek independent financial advice regarding their taxation obligations arising from accessing long service entitlements under these financial hardship provisions.
