Privacy policy

PURPOSE:

The purpose of this policy is to detail requirements for dealing with records and personal information of staff, board directors, workers, employers and other members of the public.

SCOPE:

This policy shall apply to all board members, agents, contractors and staff of QLeave who have authorised access to records and personal information collected or recorded for the purposes of administration of the Building and Construction Industry (Portable Long Service Leave) Act 1991, the Contract Cleaning Industry (Portable Long Service Leave) Act 2005, the Community Services Industry (Portable Long Service Leave) Act 2020 or as otherwise required or permitted by law.

CONTEXT:

Where the context requires or permits, 'QLeave' includes the Contract Cleaning Industry (Portable Long Service Leave) Authority (CCI) and the Community Services Industry (Portable Long Service Leave) Authority (CSI), their boards and staff of QLeave performing administrative support services for CCI and CSI respectively.

This policy is based on:

Section 104 of the Building and Construction Industry (Portable Long Service Leave) Act 1991 (the Act)
Section 135 of the Contract Cleaning Industry (Portable Long Service Leave) Act 2005 (the Act)
Section 118 of the Community Services Industry (Portable Long Service Leave) Act 2020 (the Act) 
The requirements of the Information Privacy Act 2009 (IPA)
Code of Conduct
Public Sector Act 2022 and Public Sector Regulation 2023 and accompanying Directives.

POLICY:

QLeave is committed to the Queensland government's privacy regime.  Information collected during the course of business operations could be of a sensitive nature and could include but is not limited to:

  • Name
  • Address
  • Age
  • Date of birth
  • Telephone numbers
  • Email address
  • Rates of pay
  • Tax File Number
  • Employment history

The IPA defines 'personal information' and lists requirements for how personal information is to be collected, stored, used and disclosed.

Collection of Personal Information

QLeave will only collect personal information necessary for, or directly related to, its activities and functions and only by fair means.  When collecting personal information QLeave will ensure that a person is generally aware of:

  1. The purpose for which information is being collected;
  2. To whom the information is disclosed; and
  3. Whether collection is authorised by law.

Storage and Security of Personal Information

QLeave has possession of personal information and will ensure that there are reasonable safeguards against unauthorised access, use, modification or disclosure of the information.  The information may be held in a database, paper records, or other media.  Personal information does not include information that is publicly available and for the privacy regime does not include information relating to a deceased person or a corporation.

All personal information shall be stored in accordance with the provisions of the IPA.

Access to and Alteration of Personal Information

Individuals are entitled to seek access to their personal information and to amend those records if they are inaccurate, in accordance with QLeave's current procedures.  Individuals may also utilise their access and amending rights under the Right To Information Act 2009.

Any RTI requests shall be forwarded to the Executive Officer (who is also the Right To Information/Information Privacy Manager) for processing.

Accuracy of Personal Information

QLeave will take all reasonable steps to ensure that any personal information used is accurate, current and complete.

Use and Disclosure of Personal Information

In general, QLeave will use personal information only for the purpose for which it was collected and disclose personal information only if the individual concerned is reasonably aware of, or has consented to that disclosure or under the provisions of Section 104 of the Building and Construction Industry (Portable Long Service Leave) Act 1991, Section 135 of the Contract Cleaning Industry (Portable Long Service Leave) Act 2005 and section 118 of the Community Services Industry (Portable Long Service) Leave Act 2020.

However, QLeave may use or disclose personal information for any other purpose if prior approval is obtained or if it is required or permitted by law.

Complaint

If anyone wishes to lodge a complaint regarding the handling of their personal information staff are to record the complaint in accordance with QLeave's policy and procedures for Complaint Management.
